  1. Types of personal data and processing methods

2.1. The Processor will process the personal data that you have communicated or that has been legitimately obtained ("Personal Data"). The Processor will be Adclean or another related or unrelated company duly authorized by Adclean for this purpose.  

Specifically, the following personal data may be processed:

  1. a) Identification data: data allowing direct identification, such as name, surname, address, identity card, email address, landline or mobile phone number, provided to the Data Processor during communications. We will process this Personal Data when you ask questions, request information, or send us various communications. 

The processing of this Personal Data is necessary to respond to the communications or requests made by you.

At times, such data may be enriched with publicly available information sources in Chile.

  1. b) Navigation data: computer and telematic systems, and software procedures used to operate the Website acquire, during their normal operation, certain data (e.g., date and time of access, pages visited, name of the Internet Service Provider, and Internet Protocol or IP address through which you access the Internet, Internet address from which you connected to our Site, etc.), the transmission of which is implicit in the use of web communication protocols or useful for better management and optimization of the data transmission and email system.
  2. c) Payment data: those provided in case of purchasing products, including identification details.
  3. e) Contact data: contact information, such as phone numbers, landline and/or mobile phone, email address, provided to the Data Processor during the purchase of products or at any other time. This data allows us to contact you to provide responses to your requests and/or services tailored to your needs.
  4. f) Data acquired by Customer Service: data provided during interactions with Adclean's Customer Service, including recordings of phone calls, if you have given your consent for recording, or in cases where recording is carried out under a legal or regulatory obligation.

2.2. We inform you that personal data will be processed manually and/or with the support of computer or telematic means.

3.1. The Processor will process your personal data for specific purposes and only from a specific legal basis provided by the applicable privacy and personal data protection law. Specifically, Adclean will process your Personal Data only in cases where one or more of the following legal bases are valid:

  • You have given your free, specific, informed, unequivocal, and express consent to the processing;
  • Adclean is required by law to process Personal Data.

4.1. Employees and collaborators of the Controller and the Processor, designated for this purpose;

  1. a) May access your personal data for the aforementioned purposes, for the performance of organizational, administrative, financial, and accounting activities.
  2. b) Employees and collaborators of third-party companies or other entities carrying out subcontracted activities on behalf of the Processor to enable the website to function, as external data processors.

4.2. Customer personal data may be disclosed to authorities and public services and organizations, centralized and decentralized, including courts and tribunals, as required by applicable regulations.

5.1. Your personal data will be processed in Chile in accordance with current data protection legislation.

5.2. Eventually, when necessary, your personal data may be processed outside of Chile. In these cases, it will always be ensured that an adequate level of protection is guaranteed, recognized by a specific decision of adequacy, and only possible if the owners and managers involved provide adequate guarantees of a contractual or non-contractual nature, including binding corporate rules and standard contractual clauses for data protection.

Personal data processed for the purposes set out in the Purpose and Legal Basis of Processing chapter will be retained in accordance with the principles of proportionality and necessity and, in any case, for as long as the purposes of the processing persist or have been achieved.

  1. Rights of data subjects

7.1. Under Law No. 19.628 on the Protection of Private Life, in relation to the communicated personal data, you have the right to:

  1. a) Access and request a copy of them;
  2. b) Request their correction;
  3. c) Request their deletion;
  4. d) Obtain a restriction on the processing of your personal data;
  5. e) Object to the processing of your personal data;
  6. f) Receive, in a structured, commonly used, and machine-readable format, such data to another Data Processor, when technically feasible.

7.2. We inform you that you have the right to object at any time to the processing of all or some of your personal data. In this case, Adclean will refrain from processing those to which you have objected unless it demonstrates the existence of compelling legitimate reasons to continue with said processing, or for the verification, enforcement, or defense of a right or claim before a court of law.

7.3. We inform you that, in any case, you have the right to object at any time to the processing of your personal data for direct marketing purposes, including profiling, to the extent that it is related to such direct marketing. The right to object to such processing carried out through automated contact means also extends to the processing of personal data through traditional contact means unless you only wish to object to one type of contact. If you object to processing for direct marketing purposes, your personal data will no longer be processed for these purposes.

7.4. Refusal to provide the requested personal data, or the provision of inaccurate or incomplete data, could result in the inability to provide the contracted services adequately. Customers are responsible for the accuracy of the provided data and for notifying the Controller and Processor of any changes to them.
